(in human rights law) Under the Human Rights Act1998 (s 6) “public authorities” have duties to refrain from breaching the rights in the Act and victims are provided with remedies (s 7). Government departments, local authorities, and courts and tribunals are all public authorities. A private body carrying out public functions is not a “public authority” (YL v Birmingham City Council [2007] UKHL 27, [2008] 1 AC 95) unless it is a care home (Health and Social Care Act 2008 s 145).
